Can I Legally Carry My Handgun in Texas if I’m Wearing a Mask?

Why Is It Illegal to Wear a Mask While Carrying a Handgun in Texas

When we think about masks or facial coverings in connection with carrying weapons, we tend to envision events such as high-profile bank robberies. While this association is probably the result of a steady diet of Hollywood films and TV shows, masked gunmen robbing banks is something that has actually taken place in Texas and other states more than once in the past. It could be argued that someone who tries to conceal his or her identity with some sort of mask while carrying a firearm would be up to no good.

Now that we’re in the midst of the COVID-19 pandemic of 2020, this would be a good time to review what Texas statutes and local mandates have to say about wearing masks and carrying firearms. The firearms education pros from Online LTC, a premier provider of CHL online classes, explain.

Texas Executive Order GA-29

By order of Governor Greg Abbott and under the guidance of the Texas Division of Emergency Management, Texans are directed to wear face coverings over their mouths and noses whenever they’re in spaces that are open to the public. The only exception to this rule would be when there’s ample distance between individuals who don’t live in the same household. This measure is designed to mitigate COVID-19 contagion.

Section 411.172 of the Texas Government Code

The laws and regulations governing the eligibility and issuance of licenses to carry handguns are silent on the issue of wearing masks. The right to bear arms isn’t directly related to wearing a surgical mask, a respirator graded N95, or a clear face shield. As long as the face covering you’re wearing complies with the aforementioned executive order, you can legally carry a handgun.

Common Sense & Masked Carry

Needless to say, a balaclava or a hood that covers your entire visage wouldn’t be considered a face covering for the purpose of mitigating the spread of COVID-19. Common sense suggests walking into a police station while brandishing a weapon and wearing this type of mask wouldn’t be a good idea. However, there’s no law that prevents wearing any type of covering while carrying a gun. As long as the establishment allows for the carrying of a firearm (no 30.06 or 30.07 signs posted), you can legally carry a gun while wearing any covering.
